Jibrin’s constituents sue Dogara, N’Assembly over suspension.

Aggrieved by the suspension of their representative, Abdulmumin Jibrin Kofa, from the House of Representatives, electorates of Bebeji/Kiru federal constituency, have taken the Speaker, Yakubu Dogara, House of Representatives and the House Clerk to court.

 

Jibrin was suspended from the lower federal legislature for 180 days for his role in the alleged padding of the 2016 budget.

 

Counsel to the aggrieved party, Barrister Bashir Muhammad Muqaddam, briefed journalists, yesterday, in Kano, after filing the case at the Federal High Court, Court 2.

Muqaddam revealed that the constituents were challenging the authenticity of the suspension of the former Chairman of the House Committee on Appropriation, stressing, “His suspension breaks many ground rules, from the House to the Constitution of the Federal Republic of Nigeria. ”

 

“We are contesting the action; that is why we are taking them to court, so that we can get proper interpretation of the purported suspension of the member,” he said.

Senate lifts suspension on police recruitment

The recruitment of 10,000 personnel into the Nigeria Police will now continue as the Senate has lifted its suspension on the exercise.

The new condition is that the new policemen will be employed based on their local government areas and would be deployed in their communities.

The recruitment was suspended following a clash between the Senate and the Police Service Commission.

The Senate had, in a letter four weeks ago, asked the PSC to suspend the recruitment over alleged irregularities in the criteria adopted.

The lawmakers had asked that the recruitment be done on local government but the PSC insisted that it should be done on state basis.

The Chairman, Senate Committee on Police Affairs, Senator Abu Ibrahim (APC, Katsina-South), however, told journalists in Abuja on Monday that the commission could now continue with the recruitment.

Ibrahim announced that the clash between the Senate and the PSC had been resolved.

“We have resolved the issue and the recruitment would be done on local government basis. Very soon, the exercise will resume,” he said.

The lawmaker stated that the new intakes would form the foundation for the commencement of community policing in the country.

He said, “Nine personnel would be recruited per local government area. The policemen would be used to form a unit for community policing in all the 774 local government areas of the country.”

Suspension: Jibrin withdraws suit against House of Reps.

The Federal High Court, Abuja, on Friday struck out the suit of former Chairman, House of Representatives Committee on Appropriations, Mr. Abdulmumin Jibrin, challenging his suspension from the House.

The judge, Justice John Tsoho, struck out the matter after Jibrin’s Counsel, Mr. Chukuma Nwachukwu, told the court that his client had filed a notice of discontinuance.

Tsoho decline the request of the defendants for a N200, 000 cost, holding that the defendants were “strong institution and personality”.

At the hearing, Jibrin’s counsel, Nwachukwu, told the court that there was a notice of discontinuance filed on Oct. 11, urging the court to discontinue the matter.

The Counsel to the defendants, Mr. Kalu Onuoha, did not oppose the application, but asked for a cost of N200,000 for the processes filed by them.

He said the defendants filed many processes in this case before the court went on vacation in July 2016.

Nwachukwu, however, opposed the application with the fact that the defendants did not file any defence in the matter.

It will be recalled that Jibrin, a lawmaker from Kano State, was suspended by the House of Representatives for 180 legislative days .

However, the embattled legislator’s suit seeking stop the House is still pending in court.

Jibrin’s Suspension Is Unconstitutional – Femi Gbajabiamila

Majority leader of the House of Reps, Femi Gbajabiamila, has kicked against the suspension of former chairman of the House committee on Appropriations, Abdulmumin Jibrin for one year, describing it as unconstitutional.

The House had on 28th September, suspended Jibrin for failing to appear before the committee on Ethics and Privileges over the allegations of Budget padding he leveled on Speaker Yakubu Dogara and 13 other lawmakers.

In an interview with Thisday, Gbajabiamila questioned the legality of suspending a lawmaker who represents a constituency from the House.

He said, “My concern on the suspension is the same that I always had, even when Dino Melaye and others, were suspended in the 6th Assembly.

“Now what is this concern? I find it difficult as a Constitutional Lawyer, to accept that our rules can actually pass constitutional muster, if put to test. If you suspend a member for a year, you are effectively suspending his constituency and the people he represents, from participation in participatory democracy. This, in my own personal opinion, violates the constitution which delineates the country into Federal Constituencies for effective representation, at the centre. For every constituency, it is a right to be represented in the national assembly, not a privilege that can be taken away.

“The constitution says clearly that, all Federal Constituencies must be represented for 4 years, and lists, I believe, only 1 or 2 circumstances under which such a constituency can be unrepresented. e.g. by process of recall etc. Even at that, the vacancy is to be filled immediately.

“Our constitution does not envisage a situation where a Federal Constituency is unrepresented or underrepresented. If, for instance, an issue comes up in a member’s constituency, that requires federal attention or legislative address, who do they go to? We cannot take away a mandate, given by the people or short change a constituency.

“In law, the seat of a representative is held in trust for the constituency. It is an in rem matter, not a personal matter. This is why when a member gets up to speak, he goes through the formality of announcing his name and the constituency he represents.

“In fact, in other democracies and Legislatures, when a Speaker wants to recognise a Representative to speak, he addresses him or her not even by name, but as for instance, “the gentleman from so so constituency”. That is the pre-eminence given to a constituency in a democratic setting.

“So it is not about Honourable Jibrin, it is about Bebeji Constituency. I do not stand in the gap for Jibrin, or is this in any way a defence on his behalf. You may not know this, but Jibrin and I stopped relating as friends and colleagues, since March or thereabout.

“However, I am not one to shy away from the truth and the rule of law. I believe that there are other ways that would be constitutional, if the House wants to discipline any member.

“On whether this was contempt of court, I believe that you are speaking about the Federal High Court decision in the Melaye case, when the Court said that the House lacked the powers to suspend the members. I do not remember the basis upon which the Court made its decision, but I will definitely look at it again. I suspect it was on the basis of fair hearing, as provided in the Constitution.” he said

Budget Padding Scandal: Jibrin vows to upturn suspension in court

Following his suspension by the House of Representatives, Abdulmumin Jibrin, on Wednesday night said he would seek redress in court.

The House on Wednesday afternoon slammed 180 legislative days —a full session— suspension on Mr. Jibrin after being found guilty of violating ethics and privileges of lawmakers.

Mr. Jibrin through his widely publicised allegations of budget fraud against the Speaker of the House and over a dozen other lawmakers had stirred controversies and subjected the House to public scrutiny since July.

But the lawmaker remained defiant, saying he had done nothing wrong and, as such, will not apologise.

“Let me say, I will never ever apologise to anybody in the House of Representatives,” Mr. Jibrin said in a statement. “I did not commit any offence.”

Mr. Jibrin’s allegations against Speaker Yakubu Dogara and others stemmed from his ouster as the chair of the much-coveted Committee on Appropriation.

Mr. Dogara announced Mr. Jibrin’s removal shortly before the House proceeded on an eight-week-long recess July 20, citing budget fraud and serial betrayal of trust.

On September 21, barely a day after resuming, Mr. Dogara’s loyalists moved a motion at the plenary seeking disciplinary actions against Mr. Jibrin.

Emmanuel Orker-Jev, a lawmaker from Benue, proposed tough sanctions against Mr. Jibrin for the damage his allegations had wrought on the House.

The image of the House has never been worse than this before. Hon. Jibrin was reckless and the allegations were false. He knew that the allegations were false and scandalous and he had no regards at all to whether the allegations were true or false,” Mr. Orker-Jev said.

The House subsequently assigned the matter to its Ethics and Privileges Committee for further investigation and to report back within a week with its findings and recommendations.

Nicholas Ossai, chairman of the committee, convened the first hearing on the matter September 23, during which Mr. Orker-Jev submitted his evidence against Mr. Jibrin.

Mr. Jibrin received an invitation to appear before the committee on Monday. But he decided to boycott the hearing, even though his demand that the sitting be thrown open to the public was met by Mr. Ossai.

Mr. Jibrin also asked his lawyer, Femi Falana, to seek discontinuation of the committee’s activities saying continuing  would amount to subjudice as the matter was in court.

Mr. Ossai said Mr. Jibrin’s failure to appear before his “properly and constitutionally constituted committee” was, in effect, a defence.

The report of the committee was laid before the House plenary at noon on Wednesday.

By 2:30 p.m., the House voted to adopt the recommendations of the committee as read out by Mr. Ossai on the floor.

The recommendations included a 180-day suspension, a formal letter of apology and a removal of rights to hold position of responsibility through the span of the current 8th National Assembly.

Although analysts said it was draconian and counterproductive, Mr. Jibrin’s, nonetheless, saw a bright spot in his suspension.

“At this point, I must say they freed me up to concentrate on the matter in court,” Mr. Jibrin said. “I know the suspension is not going to stand, secondly, I’m going into a massive alliance with civil society groups, NGOs and well meaning Nigerian to continue to press ahead.”

Analysts also said Mr. Jibrin’s suspension did not resolve the questions of what the House would do about the allegations of budget fraud confronting it.

House spokesman, Abdulrazak Namdas, did not respond to PREMIUM TIMES’ request for comment about this Wednesday night.

A top lawmaker in the House said the lawmakers will not consider Mr. Jibrin’s allegations since he didn’t present anything before them.

“I understand people want his allegations investigated,” the source told PREMIUM TIMES Wednesday night. “But don’t forget he didn’t present them before us.”

“He had an opportunity to do this last week when someone raised a motion for his suspension, but instead walked out in a show of arrogance.”

Mr. Jibrin is the first lawmaker to be suspended since 2010 when Dino Melaye and 10 others were found guilty of breaching House ethics and privileges.

West Idahosa, Austin Nwachukwu, Gbenga Onigbogi, Doris Uboh, Gbenga Oduaye, Independence Ogunewe, Solomon Achinawhi, Kayode Amusa, Anas Abass, and Bitmus Kaze received indefinite suspension alongside Mr. Melaye on June 22, 2010 under the speakership of Dimeji Bankole.

Mr. Melaye is now a senator representing Kogi West.

In the 4th National Assembly, 1999 -2003, two senators, Arthur Nzeribe and Joseph Waku, were suspended for ethical misconduct.

Mr. Jibrin’s suspension would see him barred from the premises of the National Assembly in the course of the disciplinary action. His office will be sealed and will not receive salaries or allowances.

Jibrin warns House against suspension

Erstwhile chairman of the House of Representatives Appropriation Committee, Abdulmumin Jibrin, Tuesday expressed deep apprehension over his imminent suspension from the House that may follow the outcome of the Ethics and Privileges Committee’s investigative hearing which he shunned.

Jibrin at a press briefing Tuesday, warned the House over his suspension on a matter, which he said was already in court.

The lawmaker who said slamming suspension on him would amount to contempt of court, said he refused to attend the
committee’s sessions as it never communicated to him in his letter of invitation the offences that he was accused of.

He further said the committee was not able to restore his confidence on it as he had severally complained of the meddlesomeness of its chairman, Ossai Nicholas Ossai, on the allegations he raised against Speaker Yakubu Dogara that led to his alleged misconduct.

“I was not served notice of the allegations by the Ethics Committee. I didn’t know what I was to defend myself of. They only told me in their invitation that the House referred a motion to them and that I should come with relevant documents,” Jibrin claimed.

He said he was interested in knowing how he breeched the privileges of members and those he breeched their privileges and not for the House to lump everything together.

Jibrin said he was giving the committee till the end of this week to investigate the allegations he raised against Dogara and others, otherwise, he would go out of his way to expose the shoddy deal of each member of the committee.

He said he was not ready to stop the anti-corruption struggle and would never lobby any member to join him if that is what they are waiting for, adding that he is ready to stand alone to the end.

He was however of the opinion that the support Dogara was enjoying presently was cosmetics, as he allegedly blackmailed members into it, assuring that he would expose the blackmail soon.

My Suspension Cannot Stand- Jibrin

Former House of Representatives Appropriations Committee Chairman, Abdulmumin Jibrin, who was suspended from the parliament for 180 legislative days has said the action was flawed and would not stand anywhere in the world.

He  said, “It is a non-issue and complete nonsense and it is not going to stand anywhere in the world.

“As you are aware,  the matter is a subject of litigation, I have instructed my lawyer, Femi Falana SAN to file charges of contempt against Speaker Dogara and of course the House of Representatives and I’m sure the matter will move over to the judiciary and decision will be taken. I’m pretty sure it will be in my favour.”

He stressed that those waiting to receive an apology from him should perish the thought because he would never ever apologise to anybody in the House of Representatives.  He insisted that he has lived above board since coming to the House five years ago adding that allegations he raised against the Speaker and other members of the body of Principal officers were yet to be addressed.

Jibrin said, “What is very important also is that now they have done their worst, they have suspended me, what has it changed? Has it changed the fact that the speaker conspired with other principal officers to divert N40 billion out of N100 billion meant for constituency projects.

The former Chairman said his suspension has provided him time to concentrate on the matter in court adding that he was confident that the suspension is not going to stand.

Aviation Unions React To Aero Contractor’s Suspension Of Operations

Leaders of aviation workers’ union have expressed different views on Aero Contractors’ to suspend flight operations from September 1.

Isaac Balami, president, National Association of Aircraft Pilots and Engineers, applauded the decision.

Mr. Balami, while speaking with the News Agency of Nigeria (NAN), said the decision of the airline was necessary in order not to destroy the safety records it had maintained over the years.

He said it was not reasonable to continue to fly when safety could not be guaranteed, adding that the airline had not carried out proper checks and maintenance because of lack of funds.

According to him, Asset Management Corporation of Nigeria (AMCON) has been providing lifeline for the airline but has since stopped putting in money.

“Due to the shortage of foreign exchange, about six or seven Aero aircraft have not undergone C-check for sometime now which is a serious safety issue.

“There is also the issue of high cost of aviation fuel which has also contributed to the non-profitability of operation.

As a professional in the industry, I believe that safety comes first,” he said.

On the other hand, Banjamin Okewu, president, Air Transport Senior Staff Association of Nigeria (ATSSAN), said the management of Aero did not carry its members along before taking the decision.

Mr. Okewu said that the Federal Ministry of Labour and Employment had recently asked them to go into negotiation with the airline on the matter.

He said the airline unilaterally took the decision to suspend its operation without consulting the union.

According to him, it is not possible to take such decision without engaging their members.

“We have asked our people to come to work tomorrow while we meet to decide on what to do,” he said.

Commissioner Suspends 5 Primary School Teachers In Sokoto For Absenteeism

Sokoto State Commissioner for Basic Education, Dr Jabbi Kilgore has suspended five teachers of Tsaki Primary School in Kware Local Government for absenting themselves from the school without permission.

 

Kilgore told the News Agency of Nigeria (NAN) on Wednesday shortly after addressing staff and pupils of the school, that the state government would not tolerate any act capable of sabotaging its efforts at reviving the education sector.

 

He directed the suspended teachers to report to the Education Secretary of the local council for further disciplinary action.

 

“Already the state government had sought the support of traditional rulers in monitoring the conduct of primary school teachers across the state.

“The royal fathers are expected to report to the education secretary any teacher that fails to report to his/her duty post.

“Parents are also to complement the efforts of the state government by sending their children to school in good time,’’ he said.

 

He said that the government had taken concrete measures to ensure the provision of modern learning materials to public schools across the state.

 

“We are committed to providing an enabling environment for our pupils to acquire western education to enable them contribute positively to nation’s building,” he said.

APC Moves To Suspend Kwankwaso Over Alleged Anti-Party Activities

The leadership of the All Progressives Congress, APC, Kano State chapter has initiated moves to suspend former Governor of the state, Senator Rabiu Kwankwaso for alleged anti-party activities.

 

The chairman, Kano chapter of the party, Alhaji Haruna Umar Doguwa, told newsmen in Kano that the senator had during a recent visit to the state allegedly exhibited actions capable of compromising the party’s unity. According to Doguwa: “The case of party indiscipline by Kwankwaso would be thoroughly investigated and dealt with in accordance with the constitution of our party”

 

Kwankwaso was alleged to have stormed Abdullahi Ganduje village on a condolence visit with supporters chanting perceived derogatory songs against the bereaved the state governor, Alhaji Abdulahi Ganduje. Doguwa claimed that “what specifically made the visit a misdemeanour to our party spirit of discipline and brotherhood was the fact that the visit was purely political as against the mission of condolence.

 

The act of thuggery and brazen show of daggers, swords and other dangerous weapons by sponsored/hired hoodlums was totally unwholesome and condemnable.” He declared that the party acknowledged his presidential ambition, maintaining that “our loyalty and commitment is to President Muhammadu Buhari, his policies and programmes”.

 

Doguwa said the party would ensure that discipline is enforced as prescribed by the party’s constitution. Efforts by Vanguard to get reaction from the former Governor through Aminu Abdulsalam, his former Commissioner, Government House Affairs, was unsuccessful.

 

“We want to react formally to issues raised by party chairman but at the moment, we are waiting to take delivery of the conference paper,” he said.

Senate Panel Recommends Marafa’s Suspension

The Senate Ethics, Privileges and Public Petitions has recommended the suspension of Senator Kabiru Marafa (APC, Zamfara Central) over his support for statement of a former President Olusegun Obasanjo that the National Assembly is corrupt.

 
Marafa had in a reaction to Obasanjo’s letter said he was in total support that the National Assembly budget be made public.
The Senate had penultimate Tuesday following a point of order raised by Senator Isa Hamma Misau (APC, Bauchi Central) mandated the committee to probe Marafa over his remarks on the former president’s statement.
Chairman of the committee, Senator Samuel Anyanwu (PDP, Imo East) had on Tuesday submitted the report of the committee on Marafa’s probe.
A member of the committee told our correspondent yesterday that they have recommended the suspension of Marafa.
“We have recommended the suspension of Marafa but we didn’t state the time that the suspension will start in our report. The period would be decided on the floor whenever our report is considered,” he said on condition of anonymity.

Court Dismisses Adamawa Lawmaker’s Suit Against Suspension

A Yola High Court presided over by Justice Ambrose Mammadi has struck out a suit by a member of the Adamawa House of Assembly, Alhaji Abdulrahman Abubakar, challenging his suspension by the House for three months.

 

Abubakar represents Mubi South Constituency in the House on the platform of the APC.
Mammadi in a ruling on Thursday in Yola said the court has no jurisdiction to interfere in the affairs of the legislature.
Mammadi, who ruled on the preliminary objection by the respondents challenging the court jurisdiction to entertain the suit, declared that the matter was an internal affair of the House and was therefore struck out.
The News Agency of Nigeria (NAN) recalls that Abubakar had in 2015 dragged the Speaker, Alhaji Kabiru Mijinyawa, and the Assembly to court over his suspension for three months and dissolution of the House Committee on Finance, which he chaired.
The state Attorney General was later joined in the suit as a 3rd respondent.
Abubakar was suspended in November 2015 for improper dressing and violation of the House rules.
The suspension followed Abubakar’s media interview in which he criticised the Assembly’s decision to approve a sectoral virement for the executive in the 2015 budget.
Commenting on the ruling, counsel to the respondents, Mr M. A. Abdulkadir, described it as “a well considered judgement”.
On his part, counsel to the plaintiff, Mr Ever Udo, said “we may consider appeal”.
But in his reaction, Abubakar said “I leave the matter to God”.

Police Deny Meeting With APC Leaders Over Senator Shehu Sani’s Suspension

The Kaduna State Police Command on Thursday denied holding meeting with any politcal group over Sen. Shehu Sani’s suspension by the APC in the state.

 

 

The Police Public Relations Officer (PPRO), Zubairu Abubakar, a DSP, told the News Agency of Nigeria (NAN) in a telephone interview in Kaduna that the command did not hold any meeting with the leadership of All Progressive Congress (APC) on Wednesday.

 

 

“I am not aware of any meeting with the APC leadership in the state on Wednesday.”

 

 

Abubakar was reacting to a statement issued by the APC in the state that the Police Command had summoned the party leadership on Wednesday, Jan. 13, over the suspension of Sen. Shehu Sani.

 

 

The Assistant Publicity Secretary of the party, Salisu Wusono who issued the statement earlier on Thursday in Kaduna, said that the Command had expressed satisfaction with the reasons the party advanced for Sani’s suspension.

 

 

The statement reads in part “On Wednesday, we got invitation from the police, following our reaffirmation of Senator Shehu Sani’s suspension.

 

 

“As leaders of a disciplined party and law abiding citizens, we honored the invitation and the police were satisfied with our presentation.

 

 

“We told them that, the 11-month suspension stands and was done in line with the party’s constitution.

 

“There is no single individual no matter his or her status, that is above the party.

 

 

”The 11-month suspension stands and it was done in accordance with our constitution and powers vested in the leadership,”Wusono had said in the statement.

 

 

According to him, the embattled senator, who represents Kaduna Central Senatorial District, had complained to the police, on the party’s insistence of suspending him after intervention of the Deputy National Chairman (North-West), Alhaji Inuwa Abdulkadir.

Delta Assembly Suspends Two Lawmakers For Desecrating The Chamber

Two members of Delta House of Assembly, have been suspended for alleged desecration of the hallow chamber.

The members, who were suspended during plenary on Tuesday are: Mrs Pat Ajudua, Chief Whip and Mr Johnson Erijo, member representing Isoko South II constituency.

The suspension of the two legislators followed a motion moved by Majority Leader Mr Tim Owhefere.

Moving the motion, Owhefere said that the sanctity of the House must be respected at all times.

He said that Ajudua and Erijo erred in this direction.

The motion, which was unanimously adopted by the House was seconded by Minority Leader Mr Festus Okoh.

Also during Tuesday’s plenary, the Speaker, Mr Monday Igbuya, called on members to re-double their efforts in the business of lawmaking for peace and good governance of the state.

The governor also directed that all teachers with effect from next year must be in suits during official hours. A letter signed by the Permanent Secretary in the state Ministry of Education, Mrs Anne O. Odey, dated October 21, said the suspension of prayers will subsist till further notice.

The directive which was sent to all zonal heads in the state said, “the ministry hereby directs all public and private primary and secondary schools across the state to suspend all assemblies (morning and afternoon) till further notice.”

All school heads were directed to comply strictly or risk sanctions.
