I Remain Abia Governor, Says Ikpeazu

Abia State Governor, Dr. Okezie Ikpeazu, has assured the people of his state that he remains their governor and shall appeal the Federal High Court ruling, which yesterday set aside his election citing his non-qualification to contest the 2015 governorship election for tax evasion as reason for his sack.

Justice Okon Abang of the Federal High Court, Abuja, who delivered the judgment, also ordered the Independent National Electoral Commission (INEC) to issue a certificate of return to Uche Samson Ogah, a member of the Peoples Democratic Party (PDP), who contested the party’s primary that produced the governor.

Justice Abang gave the verdict in a ruling he delivered on a pre-election matter challenging the emergence of Ikpeazu as the standard-bearer of the PDP in the 2015 gubernatorial election in Abia and ordered Ikpeazu to vacate the office immediately.

He said his judgment was based on the Supreme Court decision in the case of Obi v INEC and Amaechi v INEC.

Court Sacks Abia State Governor, Okezie Ikpeazu

The Federal High Court, sitting in Abuja, has annulled the election of Governor Okezie Ikpeazu of Abia State, the News Agency of Nigeria is reporting.

The court also ordered the Independent National Electoral Commission to issue a certificate of return to Samson Ogah, a member of the Peoples Democratic Party, who contested the governorship ticket with the governor.

The court held that Mr. Ikpeazu was guilty of tax evasion and was therefore unqualified to have contested the 2015 governorship election in the state.

The court also ordered the governor to vacate office immediately, and hand over to Mr. Ogah, owner of Masters Energy, who came second in the PDP governorship primaries in Abia.

Mr. Ikpeazu is yet to comment on the judgment.

Appeal Court Sacks Abia Governor, Okezie Ikpeazu, Declares APGA’s Alex Otti Winner

The Court of Appeal, sitting in Owerri, has removed Okezie Ikpeazu of the Peoples Democratic Party as governor of Abia State.

The court also declared Alex Otti of the All Progressives Grand Alliance  the winner of the April 11 and April 25 supplementary elections in the state.

Delivering judgment in an appeal filed by Mr. Otti, the five-member panel, headed by Justice Oyebisi Omoleye, said the APGA candidate scored 164, 444 valid votes to defeat Mr. Ikpeazu who scored 114, 444 votes.

The court declared that Mr. Otti was the winner of the April 11 and April 25 supplementary elections in Abia.

Justice Omoleye said the cancellation of the elections held in three LGAs of Obingwa, Osisioma Ngwa and Isiala Ngwa by the returning officers after the results were uploaded to INEC was wrong.

“In the Electoral Act, the Returning Officer has the right to only declare results of elections and not to cancel elections.

“This panel discovered that the earlier results uploaded to INEC headquarters correspond with the correct valid registered voters in the three LGAs, while that awarded to the respondent shows over voting and therefore null and void.’’
