Court restrains Stella Oduah from withdrawing cash in banks.

A Federal High Court, Lagos, has restrained Senator Stella Oduah and Sea Petroleum and Gas Company Limited and its directors from making any withdrawal whatsoever from the account of the company.

The restriction order also involves three other limited liability companies, namely Sea Shipping Agency Limited, Rotary Engineering Services Limited and Tour Afrique Company Limited.

The accounts of those firms are domiciled in 21 commercial banks listed before the court. The order followed an alleged indebtedness of $16,412,819.06 and N100,493,225.59 to Sterling Bank.

The order of the court was sequel to an affidavit sworn to by Business Manager, Sterling Bank Plc., Mr. Segun Akinsanya, filed and argued before the court by Kemi Balogun (SAN).

Akinsanya, in the affidavit, averred that on October 8, 2012, the bank granted a lease/cabotage vessel finance facility to Sea Petroleum and Gas Company in the sum of $10,069,620.25 to finance one unit 5,000MT tanker vessel.

“The loan was secured by unconditional personal guarantee of the companies’ director, Oduah, and supported by statement of her networth, legal mortgage of two property worth N135 million and power of attorney of the tanker vessel in favour of Sterling Bank.

“There was also a fully executed irrevocable standing payment order and tripartite remittance agreement between First Bank Plc, Sterling Bank and Stella Oduah,” Akinsanya swore.

He further averred that Sea Petroleum and Gas Company requested for and was granted additional facilities in the sum of $449,600 for post-delivery expenses, $642,954 and $350,000 to meet the requisite conditions in securing the release of the tanker from the federal high court.

According to him, upon the persistent failure of the defendants to liquidate their indebtedness, Sterling Bank instructed the law firm of Oluwakemi Balogun to recover the debt.

Meanwhile, Oduah and her companies while urging the court to discharge the order, also filed a preliminary objection urging the court to strike out the suit on the ground that the court lacks jurisdiction to entertain it.

Justice Abdulaziz Anka has adjourned till March 20, 2017 to decide either to vacate the order or not.

N255m Armoured Cars: Court Refuses To Stop Oduah’s Arrest

A Federal High Court in Abuja on Wednesday dismissed an application by a former Minister of Aviation, Stella Oduah, asking ?for an order stopping the Economic and Financial Crimes Commission and the police from arresting her with respect to ongoing investigation into corruption allegation against her.

Oduah had filed the fundamental rights enforcement suit, asking the court to prohibit the Attorney-General of the Federation’s office, the EFCC, and the police from “inviting, arresting, investigating or prosecuting” her over the purchase of two armoured BMW vehicles at a cost of N255m by the Nigerian Civil Aviation Authority under her watch as the Aviation Minister in 2013.

A similar fundamental human rights enforcement suit filed by the former minister, who is now a
Senator representing Anambra North, was earlier struck out by Justice Okon Abang, then sitting in the Lagos Division, on February 17, 2016, for want of territorial jurisdiction.

Justice Abdu Kafarati in his judgment on Wednesday, upheld the objection raised by the respondents, to the effect that the court lacked the requisite jurisdiction to hear the case because the prayer sought in it was outside the ambit Chapter 4 of the Constitution which captured enforceable rights of persons.

He held that that no court had the power to stop security agencies from carrying out their duty of investigation.

He also said such prayer could not constitute a fundamental rights action.

He said it was in the interest of a person suspected of crimes to be invited by the investigating agency so that the suspect could give his or her own side of the story.

He added that the suit did not disclose any reasonable cause of action.

He said, “It is not grantable by this court because the court cannot stop security agencies from carrying out their duties. There is no way a person can be investigated without being invited by (the) body charged with the responsibility of investigation.

“In most cases, the invitation is even in the interest of the invitee because he or she will have the opportunity of giving his or her side of the story.

“I therefore hold that the application seeking to stop security agencies from inviting, investigating, arresting and/or prosecuting any person suspected to have committed an offence does not constitute a fundamental right action.”

Oduah had argued that the criminal allegations leveled against her as minister had been investigated by the EFCC and the House of Representatives’ Committee on Aviation, which both absolved her of any wrong doing.

She had maintained that the investigation was going to be used as tool for political persecution against her.

Return My Late Son for Burial, Father Tells Stella Oduah

The former husband of Senator Stella Oduah, Lt.-Col. Satchie Emmanuel Etoromi (rtd), wednesday pleaded with the ex-Aviation Minister to return their late son, Mr. Maxwell Chinedu Toritseju Etoromi, for burial in Warri, Delta State.

The former couple’s son reportedly died suddenly at an Abuja hospital from brain haemorrhage last Friday.
Chief Etoromi, who spoke to reporters in Warri shortly after sending a powerful delegation to his royal majesty, Igwe D. O. Oduah, the Igwe of Akili Ozizor, Ogbaru in Anambra State, who is also the senator’s father, expressed deep sorrow over the death of his son.

In his letter to the traditional ruler titled, “Appeal to Intercede to Ensure Senator Stella Adaeze Oduah Brings My Son, Maxwell Chinedu Obiechina Wereyesigha Toritseju Etoromi to Me in Warri for Burial”, the bereaved father said he read about the death of their 28-year-old son in the newspapers without being informed by his ex-wife.
“His Royal Highness, Igwe Oduah I, betrothed Stella Oduah to me on the 18th November 1984 in Akili Ozizor. We married on the 16th of December 1984 in His Highness’s Palace in Akili Ozizor.

“After the payment of dowry and exchange of gifts, we were taken to Nde-Mili where we performed the final rites.
“I am surprised to see in the internet stories that my son Maxwell Omabuwa Temisanre Obiechina Wereyesigha Toritseju Chinedu Etoromi, who Stella delivered for us on 14th March 1988 at 05.00 hour in St Mary’s Hospital Ugboroke, Warri, is dead,” the bereaved father said in the letter.

He alleged that up till now, his estranged wife had not contacted him on the death of their son, but had commenced preparations to bury him last Friday in her hometown.

“Up till now, Stella has not told me my son died in her custody. There is a rumour that my son will be buried in Akili Ozizor. That is not acceptable at all. My son must be brought to me in Warri for internment,” he said.

In the letter, which was copied to Most Reverend Valerian Okeke, the Arch-Bishop of Onitsha, and the parish priest, Father Donald Uzoh of the Sacred Heart Parish, the bereaved father insisted that his late son must be returned for proper burial in his father’s place.

Supreme Court’s Judgment Is Victory For Democracy – Oduah

Senator Stella Oduah representing Anambra North Senatorial District on the platform of Peoples Democratic Party (PDP) has described her victory at the Supreme Court on Wednesday as victory for democracy.

Supreme Court Sacking Report Entirely False- Stella Oduah

Anambra Senator and Former Aviation Minister, Stella Oduah, has debunked reports that the Supreme Court has nullified her election into the Senate.

There had been reports earlier on Friday that the Supreme Court had sacked two Senators from Anambra State, Stella Oduah and Andy Uba, nearly two months after a third Senator from the state, Uche Ekwunife, was sacked.

This was following the Supreme Court ruling which re-affirmed the chairmanship of Ejike Oguebego as the authentic State Chairman of the Peoples Democratic Party (PDP) in Anambra State.

The Supreme Court also declared the list of candidates submitted by the Ken Emekayi-faction illegal.

But in an interview with Channels Television to clarify the implication of the judgement on her election into the Senate, Oduah said, “In all its entirety, it is false.

“I have gone through the court judgment and the judge clearly did not give any judgement to that effect.

“Indeed, what the judgment and the case is all about is state exco and as we all know, state exco do not do election, neither do they submit list.

“So the issue of emergence of candidate, and the issue of candidates that won election was not the issue of this particular case.”

She added that there is a “sister case” for which the Supreme Court has given a similar judgment but they were not related.

“The Judge was very clear on its judgment and it clearly says its not about who emerges or the election but about the legality of the excos,” she said.

Court To Deliver Judgement On Stella Oduah’s Suit

A Federal High Court in Lagos has fixed January 25, 2016 to deliver judgment in the fundamental rights enforcement suit filed by a former Minister of Aviation, Mrs Stella Oduah, seeking to stop an alleged plan to prosecute her over the two armoured BMW cars allegedly purchased for 255 million Naira.

The vehicles are alleged to have been bought by the Nigerian Civil Aviation Authority in 2013 during her tenure.

Justice Okon Abang adjourned for judgment on Tuesday after entertaining arguments from the parties in the suit.

Oduah had sued the Economic and Financial Crimes Commission; the Independent Corrupt Practices and other related offences Commission, the Attorney General of the Federation and the Inspector General of Police.

She claimed that the ruling All Progressives Congress’ government had perfected plans to use the defendants to persecute and humiliate her under the guise of fighting an anti-graft war.

According to the Tribune, Justice Mohammed Yunusa made the order of mandamus in a judgment delivered on Tuesday, in a suit filed by a non-governmental organisation, Enough-is-Enough.

Enough-is-Enough had, through its counsel, Mr Ayodeji Acquah, approached Yunusa, seeking an order compelling Coscharis Motors to make available to it, documents on the two cars, numbered WBAHP41050DW68032 and WBAHP41010DW68044, purchased for Oduah for about N256 million.

The organisation claimed to have commenced the action, following the refusal of the company to honour its request via a letter dated October 28, 2013.

Yunusa, in his judgment, however, assumed jurisdiction and holding that the provisions of the FOI Act was binding on Coscharis, while he subsequently ordered the automobile company to furnish Enough-is-Enough with information and documents pertaining to the cars.

Oduah was elected as a senator in Anambra on the People’s Democratic Party, PDP platform and she is one of eight female senators to join the 8th senate of the fedeation.

Stella Oduah, Andy Uba Fail to Make PDP Candidates’ List

The senatorial ambition of a former Minister of Aviation, Stella Oduah, has crashed, following her inability make the list of Peoples Democratic Party (PDP) senatorial candidates. The list was released on Tuesday by the Independent National Electoral Commission (INEC).

 Ms. Oduah, after failing to capture the Anambra North Senatorial seat, had allegedly contacted powerful government officials to use their influence to force INEC to get her name into the list.
