Code of Conduct: Ex-Minister Orubebe to appeal tribunal judgement

Former minister of Niger Delta Affairs, Elder Godsday Peter Orubebe, has said he is not guilty as pronounced by the Code of Conduct Tribunal (CCT), chairman, Danladi Umar, adding that he will appeal the judgement to secure the ‘ordinary empty land which he had since sold to the man who bought it.’

Orubebe who maintained that he did not declare the said empty land in Asokoro District, because it was no longer in his possession when he left office said, “It won’t be fair to the innocent man who bought the ordinary empty land from me when I was in distress.’

Orubebe, who believes he is being prosecuted over his outburst at the 2015 Presidential Election collation centre in Abuja, in an attempt to protest the outcome of the election, said his lawyer, Mr Selekowei Larry (SAN), will appeal against the judgment which he described as “travesty of Justice”.

According to him, the verdict was a clear example of “convict him at all cost” syndrome. He explained that the said empty plot in the Asokoro district was allocated to him by the government in 2007 as part of his ministerial entitlements Abuja.

False Asset Declaration: CCT Finds Orubebe Guilty

The Code of Conduct Tribunal, CCT, on Tuesday, found a former Minister of Niger Delta Affairs, Godsday Orubebe, guilty of false declaration of an asset.

Orubebe had been standing trial on a one-count charge of false asset declaration.

The Federal Government had claimed that Orubebe, who was a minister under the administration of former President Goodluck Jonathan, committed the offense while he was a public officer.

But the chairman of the tribunal, Danladi Umar, in his judgment, ruled:“?I hereby seize, on behalf of the federal government, the property known as plot 2057.

“The prosecution proved its case beyond reasonable doubt, and all evidence tendered are admitted.”

The tribunal chairman held that Orubebe committed an offense for not declaring a piece of property in Abuja, which the former minister claimed he had sold.

Alleged N2.3b Diversion: Orubebe, Others Get N50m Bail

A High Court of the Federal Capital Territory (FCT) in Maitama, Abuja has granted bail at N50million to former Minister of Niger Delta Affairs, Godsday Orubebe and two others arraigned before it Wednesday morning.

Godsday Orubebe, Oludare Lawrence Alaba an Assistant Director, Ministry of Niger Delta Affiars), Ephraim Tewolde Zeri (Director of Contracts in Gitto Costruzioni Generali Nigeria Limited) and the company were arraigned on a six-count charge marked: CR/265/2016.

They are, in the charge filed by the Independent Corrupt Practices and other related offences Commission (ICPC), accused among others, of diverting about N2.3b meant for the compensation of property owners to be affected by the Federal Government’s dualisation project of Section IV of the East West Road.

Orubebe and others pleaded not guilty to the charge, following which Justice Kayode Adeniyi granted the ex-Minister bail at N10m and one surety, who must be a responsible Nigerian, resident in Abuja and must show evidence of regular tax payment.

The judge granted Alaba and Zeri bail at N20m and one surety each, who are to be residents in Abuja. He said Alaba’s surety must be an Assistant Director in any Federal Government’s agency, while Zeri’s surety must own property in Abuja and show evidence of ownership.
Justice Adeniyi ordered the defendants to be kept in ICPC’s custody pending when they are able to process the bail granted them.

He adjourned to November 10 for commencement of trial.

Funds Diversion: Orubebe’s Arraignment Stalled Again

The absence of former Minister of Niger Delta Affairs, Godsday Orubebe, stalled his arraignment for alleged involvement in the diversion of about N2.3 billion public funds on Tuesday.

Orubebe, Oludare Lawrence Alaba (an Assistant Director, Ministry of Niger Delta Affairs), Ephraim Tewolde Zeri (Director of Contracts in Gitto Costruzioni Generali Nigeria Limited and the company are listed in the six-count charge marked: CR/265/2016, filed by the Independent Corrupt Practices and other Related Offences Commission (ICPC).

They are accused of diverting the N2.3 billion meant for the compensation of property owners to be affected by the Federal Government’s dualization project of Section IV of the East West Road.

This is the second time Orubebe and others’ arraignment will be shifted to a later date.

They were initially scheduled to be arraigned before Justice Olukayode Adeniyi of the High Court of the Federal Capital Territory (FCT) on August 18.

It was shifted to August 30 when prosecution lawyer, Osuobeni Akponimisingha told the court that the ICPC was yet to effect service of the charge on all defendants.

Akponimisingha told the court again on Tuesday that two of the defendants – Alaba and Zeri – were in court.

He noted that Orubebe was not in court despite the fact he had been properly served with the necessary court documents.

Orubebe’s lawyer, F. Zimuan, told the court that his client was absent in court because he is indisposed.

“His (Orubebe’s) absence is not deliberate. He suddenly took ill. He had domestic accident, which affected his ankle and wrist,” Zimuan said.

He said the development had cumulative effect on his hypertensive client, who had since been rushed to the hospital.

Orubebe In Serious Trouble!! Accused Of Diverting N1.9bn Compensation Money

The Independent Corrupt Practices and other Related Offences Commission (ICPC) has filed new charges against former Minister of Niger Delta, Godsday Orubebe, before an Abuja High Court, alleging that he diverted close to N2 billion naira meant for the dualisation of Section IV of the East-West Road.

He is charged alongside Oludare Lawrence Alaba, Ephraim Towelde Zaki and Gitto Construction Limited on a five-count charge bordering on alleged corruption, diversion of funds and perjury.

He was accused of circumventing a Federal Executive Council, (FEC) approval for the dualisation of the Eket – Oron Road, part of the East-West Road which runs from Edo to Bayelsa states, by allegedly instructing the contractor, Gitto Construction, to rehabilitate it instead.

Orubebe and the co-accused ?persons are also charged with conferring undue advantage on the construction firm when they caused the money meant for compensating residents whose properties were marked for demolition paid to Gitto.

Court papers stated that the sum of N2,320,686,826.00 approved for payment of compensation to owners of properties that were to be demolished to make way for the dualisation of the road was paid to the contractor instead of the beneficiaries.

How CCB Uncovered Orubebe’s Hidden Abuja Property – Witness

The Federal Government on Thursday opened its case against a former Minister of Niger Delta Affairs, Mr. Godsday Orubebe, who is being prosecuted before the Code of Conduct Tribunal in Abuja on one count of false asset declaration.

The first prosecution witness, Samuel Madojemu, an official of the Code of Conduct Bureau who testified on Thursday, accused Orubebe of failing to declare his property at Plot 2057, Asokoro District, Abuja, as a minister between 2007 and 2011.

Madojemu, who coordinates CCB’s “intelligence on observed breaches of the code and asset tracing investigation,” said Orubebe submitted five asset declaration forms to the bureau between 2007 and 2011, the period he served as a minister.

Orubebe submitted the five forms to the CCB, first, as Minister of Special Duties under the administration of the late President Umar Yar’Adua, and later, as Minister of Niger Delta Affairs up till 2011 under the former President Goodluck Jonathan’s administration.

The witness said the Certificate of Occupancy for the property obtained from the land registry of the Federal Capital Territory administration showed that it was issued to Orubebe on April 10, 2011 but that the former minister failed to declare it as of the time he was leaving office on May 29, 2011.

The witness, who was led in evidence by the Director of Public Prosecutions of the Federation, Mr. Mohammed Diri, said Orubebe refused to honour invitation by the bureau during the investigation of an intelligence report obtained concerning him.

Madojemu said, “The defendant declared his assets to the bureau by virtue of his position as a public officer and as a minister of the Federal Republic of Nigeria.

“I was instructed to invite him to the bureau for the purpose of obtaining his statement on the allegations and intelligence report that was being handled by the bureau concerning him.

“I invited him. He promised to respond by sending his legal team. He also promised that he might decide to come in person but he did not come.

“My lord, the bureau issued him with Form CCB 1 which is the bureau’s asset declaration form and he made his declaration between 2007 and 2011 – the period under investigation.

“The Code of Conduct Bureau issued the defendant the Form CCB 1 five times. For those five times, he made his asset declaration to the bureau.

“My lord, after we received the form, we examined the form as part of our procedures of investigation to ascertain if there was over-declaration or under-declaration.

“We conducted intelligence assessment on the declaration made by the defendant. We discovered that there were some other plots or properties that were traced to the defendant, Godsday Orubebe.

“We conducted record examination by writing a letter to the Federal Capital Territory’s Department of Land Administration.

“My lord, in their response, which was in writing, it was indicated that Plot 2057, Asokoro District, for which the Certificate of Occupancy was issued on April 10, 2011, belonged to the defendant.

“We thereafter compared the information arising from the response from the FCT Land Administration Department with the information on asset declaration forms submitted to the bureau between 2007 and 2011 and discovered that Plot 2057, Asokoro District, belonging to the defendant was not declared, even as of May 29, 2011 when he left office.

“Apart from the letter from the FCT Land Administration registry, we also received the Certified True Copy of the Certificate of Occupancy in respect of Plot number 2057 issued to the defendant.

“We also received the CTC of the Right of Occupancy for that same Plot No. 2057 issued to the defendant.

“Also received from the FCT Land Administration registry was a letter of authority given to one Rodney, an engineer, by the defendant, authorising him to collect the Certificate of Occupancy and the Right of Occupancy from the FCT Land registry. It was supported by the (passport) page of the defendant.”

Madojemu said the reason for inviting Orubebe was to ask him why he failed to declare the asset which he acquired about one month to the expiration of his tenure.

The two-man panel of the Code of Conduct Tribunal admitted as exhibits the certified true copies of all the five CCB 1 forms submitted to the bureau by Orubebe.

Orubebe’s lawyer, Mr. Selekowei Larry (SAN), did not oppose the admissibility of the documents.

But the lawyer opposed the admissibility of the Certificate of Occupancy, the Right of Occupancy, the letter of authority referred to by the witness, which were all attached to a letter dated February 18, 2016, by the Land registry of the FCT, in response to the request by the CCB.

Larry contended that the letter along with the documents attached to it was inadmissible under Section 83(3) of the Evidence Act, because it was authored by “a person interested” while the case against his client was already pending in court.

The letter dated February 18, 2016 was authored by an Assistant State Counsel in the Lands Administration Department, Mrs. Funke Audu, of the Federal Capital Territory.

“These are documents procured during the pendency of this case. The letter is dated February 18, 2016, whereas the suit commenced on October 18, 2015,” Larry said.

But the tribunal chairman, in a ruling, overruled Larry and upheld the argument by the lead prosecutor, Diri, who argued that Audu, who was an employee of the Federal Capital Territory Administration, could never be an interested party.

The documents were admitted as exhibits.

Orubebe, who was dressed in a white native attire and a black hat,  sat in the dock throughout the proceedings.

He was accompanied to court by a group of women and other supporters.

The trial was adjourned till April 14 for cross-examination of the witness.

There were media reports , yesterday claiming that the federal government has withdrawn its charges against the accused. However, the CCT, in a statement in Abuja, said that there was nothing of such and that the reports were misleading.

A statement issued by the Head, Press & Public Relations, Mr. Ibraheem Al-hassan, said in part, “Our attention at the Code of Conduct Tribunal has been drawn to recent publications from some section of mass media, indicating that the Federal Government has withdrawn charges against former Minister of Niger Delta Affairs, Mr Godsday Peter Orubebe.

“The Tribunal is compelled to refute the said publications. The purported withdrawal of the case was quoted to be based on the case being fundamentally defective. “Pursuant to the above, CCT advices that, to the best of our knowledge based on available records, as at the time of this report, the information is misleading, distortive and as such it should be ignored. “The case of Mr Godsday Peter Orubebe before CCT in Charge NO: CCT/ABJ/02/15 is on-going. What transpired in court in the last session held on 8th March, 2016 was a substitution of the initial charge with a newly filed charge by the prosecution, of which leave was sought from, and granted by the Tribunal. The case had been adjourned to 7th April, 2016. Thus; there is no withdrawal of the case by the prosecution”.

Orubebe Trial: CCB Fails To Produce Witness, Adjourns To Nov 26

The trial of former Minister of Niger Delta Affairs, Elder Godsday Orubebe, by the Code of Conduct Tribunal (CCT) over alleged four count charge of false declaration of assets and acceptance of about N70million bribe, took a dramatic turn on Monday, as the prosecution counsel failed to produce witnesses against the ex-minister.

Orubebe

After Orubebe pleaded not guilty to all the charges brought against him, the counsel to the prosecution, Ibrahim Usman, told the court, that he would like to request an adjournment since his witnesses were not in court.

The defence counsel, Selekeowe Larry, asked the tribunal to demand a statement of necessary evidences, according to rule 5 subsection 1, of the rules of the tribunal.

The tribunal judge, Umar Danladi, however, said the matter yearning for determination at the court was not for the prosecution counsel to state the evidence but for them to produce the said witnesses to do so.

He frowned at the inability of Mr. Usman and his team to produce the witnesses.

The request by Mr. Larry to have his client released on bail was not granted, as Mr. Danladi said the court had no reason to discuss his arrest or bail.

He said Mr. Orubebe was expected to always appear before the court.

Mr. Danladi ruled that the matter be adjourned till 26 November for a definite hearing.

You Are A Garage Boy, I Will Disgrace You Publicly – Orubebe Fires Back At Oshiomole

And the saga continues…Hours after Adams Oshiomole released a statement calling Godsdey Orubebe a clown, the former Minister of Niger Delta has fired back, calling the Edo state governor a garage boy who he will disgrace publicly.

“I am proud to have been a vital instrument used by God to take the once abandoned East- West road project to an admirable 80 percent level of completion. It is unfortunate that our respected Niger Delta could produced the likes of Oshiomhole who is a garage boy that should be at the motor park as a son. I will disgrace him publicly and tell the world about his dubious deeds as governor as well as his role in the botched Third Term Bid of former President Olusegun Obasanjo. I am going to open his can of worms to the point that Nigerians will stone him if seen on the streets.
I don’t talk carelessly as I have my facts to prove my points. I am not afraid of probe, am a man of integrity under whose watch the abandoned 42 bridges and 1040 culverts that was initially without designed was upgraded to the level it is today. Every reasonable Niger Deltan and Nigerians at large knows that I am the admired face of the East West road, I can stand tall, anywhere and anytime to defend my administration as well as account for every dime that was allocated for the several projects we embarked upon. My Co- ministers and every other person who was a member of the federal Executive Council under former president Jonathan’s watch can attest to the fact that I was a vessel par excellence who had result oriented contributed to make towards moving the nation forward. If he is reasonable, he will not refer to my action at the election result collation centre. This is because, history will talk about it and Nigerians will be proud of me. Yes, I had to apologise to Nigerians, particularly the youths over what I term ‘wrong approach to a just course’. Yes, I had a just case that was deliberately ignored, as one who felt cheated, and so reacted. I’m laughing at him because, if there’s anyone who should bury his face in shame, it has to be Oshiomhole who disgraced, harassed and rough handled a poor widow who he should have ordinarily accommodated. My people are very proud of me, I mean the aged, the poor and orphans. I don’t disgrace them before putting smiles on their faces. I maintain the fact that Oshiomhole is a popular villa sycophant, a garage boy and that PMB should be weary of him, if he must succeed and be really admired.”he said.

Orubebe Deserves To Rot In Jail, Oshiomhole Fumes

Governor Adams Oshiomhole of Edo State on Wednesday said former Minister of the Niger Delta, Godsday Orubebe is afraid of President Muhammadu Buhari’s planned probe of several billions of naira squandered on the East-West road and on the Amnesty programme under his watch as Minister of the Niger Delta Affairs.

The governor said that fear of an impending probe was what triggered Mr. Orubebe’s latest outburst in the media.

Mr. Oshiomhole, in a statement by his spokesperson, Peter Okhiria, said the “incompetence” of people like Mr. Orubebe contributed to the dismal failure of the administration of former president Goodluck Jonathan.

“Our attention has been drawn to the latest outburst of one clown called Godsday Orubebe in his attempt to taint the image of the Governor of Edo State, Comrade Adams Oshiomhole.

“It is no surprise that the former president, Goodluck Jonathan, failed woefully because he surrounded himself with such charlatans as Godsday Orubebe, whose only credential is his ethnic origin and the large size of his bowler hat.

“Here was a man whose un-ministerial conduct at the election nearly plunged the nation into an avoidable crisis

“Does Orubebe really think Nigerians are fools, does he truly believe Nigerians have forgotten so soon the ignoble role he played in his attempt to truncate the release of the election results and announcement of the eventual winner of that election, a move which could have plunged the nation into another civil war?

“Is it not a shame that Orubebe who should be cooling off his heel in jail for that failed plot to truncate democracy has now found a convoluted voice?

“We are not surprised at the timing of Orubebe’s latest outburst. It is no doubt unconnected with the planned probe by President Muhammadu Buhari of the billions of naira allocated to the Ministry of Niger Delta Affairs, even as the East-West road remains in bad shape and the probe of the fleecing of amnesty funds under his watch.

“We are aware that Orubebe, the perpetual noise maker, has raised the decibel of his noise a notch higher so that he would have a ready-made defence of witch-hunting if he is indicted in the planned probe of Amnesty funds.

“Orubebe is a yesterday’s man. We could have chosen to ignore him like his Delta brother, Mr. Sunny Onuesoke, an unknown entity who doesn’t know the arithmetic of financing, but decided to delve into a matter of a World Bank loan, something completely beyond his mental and intellectual capacity, but we simply can’t let Orubebe have the last say.

“We are not unaware that it has now become the fad for drowning and neophyte politicians to take cheap shots at the impeccable character of the Comrade Governor just to gain cheap publicity. However, Orubebe’s image, as he himself knows, is beyond redemption.

“Is it not laughable that Orubebe, the clown, accused Oshiomhole of biting the fingers that fed him? Pray, how did Jonathan feed Oshiomhole? Did he feed Oshiomhole by supervising over a government that fleeced the nation of trillions of naira, thereby denying Edo State her rightful share of funds for development? Or did he feed Oshiomhole by canvassing votes for him!

“Our candid advice is for Orubebe, a perpetual failed governorship aspirant, to go to his family and apologise for the irreparable damage done to the family name with his infamous outburst beamed live to the whole world, before coming forward to confront Governor Adams Oshiomhole who is not in any way in the same class as him.

“It is no wonder that Nigeria was at a state of near collapse until President Muhammadu Buhari came on a rescue mission and rendered people like Orubebe irrelevant.

“Never again will characters like Orubebe take us on the path of Golgotha; never again will they hold sway in the affairs of Nigeria and ruin the collective aspiration of the people.”

We Can Succeed Without Oil- Orubebe

A former Minister of Niger Delta Affairs, Elder Godsday Orubebe, has called on people of the region to look beyond oil, noting that the oil boom has kept the region in untold poverty.

Orubebe, made this remark while speaking at a seminar organised by the Ijaw Professional Association, IPA, in Lagos.

Speaking on the theme: “The place of the Ijaws in Nigeria: A Call to Strategic Action”, the former minister said that it was necessary for leaders of the South South, especially the Ijaw nation, to come up with a roadmap that would create employment for its people instead of putting hope on oil.

He said: “Because of oil, we have abandoned what God gave to us. We have people who are naturally fishermen and palm oil tappers. You heard when I spoke about Ogogoro (local gin), which is celebrated in China, but the authorities here are not doing anything to improve on it”.

U.S. Likely To Sanction Patience Jonathan, Orubebe, Others

The United States government appears set to sanction Nigeria’s ?first lady, Patience Jonathan, a former Niger Delta minister, Godsday Orubebe, ?and ?the ?governor of Katsina State, Ibrahim Shema, and other Nigerians accused of either disrupting the just concluded elections, or instigating violence.

The U.S. said Monday that it will impose visa restrictions on any Nigerian found to have incited violence or interfered with the electoral process.

The U.S. Assistant Secretary of State for African Affairs, Linda Thomas-Greenfield, said in a? statement that the U.S. will shut its doors on people involved in any form of violence during the polls.

“Anyone found to have incited violence or interfered with electoral processes will be unwelcome in the United States and subject to visa sanctions,” Ms. Thomas-Greenfield said.

Although Ms. Thomas-Greenfield did not give names of those considered for sanctions, Mr. Orubebe, appears one of the most likely targets.

The former minister openly disrupted the process of collation of the presidential election results in Abuja on March 31, as the event was broadcast live by the international media.

Accusing the head of the Independent National Electoral Commission, Attahiru Jega, of bias, Mr. Orubebe for several minutes asked Mr. Jega to stand down before the process could continue.

The former minister received worldwide condemnation for his actions, and later apologised.

Mrs. Jonathan had said at the ?ruling ?Peoples Democratic Party Women Campaign in Calabar, Cross River State, early March, that anyone chanting change should be stoned.

“I’m telling you, anyone that comes and tell you change, stone that person,” she said. “What you did not do 19 kilikili, is now that age has caught up with you, you want to come and change? You can’t change rather you will turn back to a baby. You will turn back to a baby. From old age nothing, so nothing like change. Rather (it) is continuity.”

Orubebe Denies Involvement In Alleged Plot To Kidnap Jega

The former minister of Niger Delta Affairs, Elder Godsday Orubebe, has denied any involvement in the alleged plot to kidnap the chairman of the Independent National Electoral Commission (INEC), Prof. Attahiru Jega at the presidential results collation centre in Abuja.

A report by Reuters had linked Orubebe to a plot to abduct Jega which was connected to his outburst at the collation centre follopwing the March 28 presidential election.

However, in an interview with LEADERSHIP, the former minister wondered why a section of the media will indulge in such “slanderous, libelous, derogatory and deliberate attempt” to dent his image and mislead Nigerians after his explanations to justify the protest he staged and the passionate apology he rendered to Nigerians.

“I am shocked. In fact, am still wondering why I will ever consider conniving with friends and other party stalwarts to foment national violence that will in turn fall on children, women and youths as falsely speculated to the detriment of the unity and peace of our great nation. I am an advocate of peace. This was why I was in the forefront to anchor the celebrated ceasefire with Niger Delta ex- militants to usher in peace to the once restive region. I cannot afford to sacrifice national unity and peace on the platter of power,” he said.

He asked to be counted out of any plot to abduct Jega. “I am too discipline to stoop that low. I have never thought of that and to this effect, I want to tell Nigerians and the world at large that the circulated story is not only slanderous, liberious but a disparaging defamatory otherwise salacious material against my personality and a cheap strategy to sale their papers.”

Orubebe, meanwhile, told LEADERSHIP that he had since directed his lawyer to write the management of ThisDay Newspapers, one of the national dailies that published the allegation, informing them of his plans to take legal action against them as well as to demand immediate retraction of its Friday, April 17 publication, which indicted him of reading a script to pave way for Jega’s kidnap.

“I have directed my lawyer to write ThisDay and stop them from henceforth, desist from further publishing and misleading Nigerians. Orubebe further accused the paper of flouting the ethics of balance reportage. I was never called nor SMS as they claim.”

When contacted, Orubebe’s lawyer S. Larry (SAN), said, he has already written to alert the paper of Orubebe’s decision to take legal action against them.

I Am Very Sorry, Please Forgive Me – Orubebe Begs

Former minister of Niger Delta Affairs, Elder Godsday Orubebe, has apologised to Nigerians over his infamous conduct at the collation and announcement of the presidential election results at the International Conference Centre (ICC) in Abuja.

Orubebe, who tendered apology to Nigerians, said he regretted his action. He also claimed that his action was sequel to the failure of Jega to treat the petition of the PDP over some results in the North.

Speaking to LEADERSHIP on the phone in Abuja, Orubebe said:
“I apologise generally to Nigerians especially to the younger generation. I want to say if my action hurt them, I deeply regret it. I am naturally a man of peace and a child of God.

“I love and hold the interest of this country at heart. Hence, my reaction was provoked by Prof Jega’s behaviour.

“I strongly believe in fairness, equity and justice which I felt we were deprived of. I sincerely apologise and request national pardon. I love peace, I preach peace and hold national unity in high esteem.

“That is why I anchored the ceasefire that is now being enjoyed in the South South region. I earnestly beg to be forgiven, in spite of the embarrassment caused to our dear people. I am indeed sorry , I was only pushed to the wall .”

He said that his action was sequel to the failure of the Chairman of the Independent Nigeria Electoral Commission (INEC) Professor Attahiru Jega to treat the petition of the PDP over some results in the North.

Barely minutes after the INEC chairman settled in to commence collation, apologising for commencing late which was due to logistics issues, former minister of Niger Delta Affairs, Elder Godsday Orubebe, and the agent of the PDP, accused the INEC chairman, Prof Attahiru Jega of being “very partisan” and compromised.

Orubebe, accused Jega of refusing to address PDP’s petition for election to be cancelled in seven states whereas the INEC chairman had sent a team of national commissioners to investigate the calls by the All Progressives Congress (APC) for the cancellation of presidential election in Rivers State.
