Incredible: Court bars FG from acting on fuel subsidy report

A federal high court sitting in Abuja, on Wednesday, granted a motion filed by Integrated oil and Gas Limited barring the Federal Government from taking any action on the fuel subsidy probe report by the House of Representatives.

The injunction, granted by Gladys Oluto, asked all parties to maintain the status quo pending the determination of the originating summons; and prevents any form of arrest, detention, prosecution and the recovery of the N13.2 billion allegedly collected by the company.

Ms. Oluto, also granted accelerated hearing in the suit.

Counsel to the plaintiff, Tayo Eyitibo, said any action taken against his client would be illegal; particularly when it (Integrated oil)is challenging the
constitutionality and credibility of the probe report owing to the controversy surrounding the outcome of the probe.

The company based its arguments on the scandal involving the chairman of the adhoc committee who is alleged to have collected a bribe of $620,000 .

Counsel to the respondents, Adegboya Awomolo, held that the order granted for accelerated hearing of the suit is important to the case as government
intends to complete investigations and prosecution, noting that the report of the committee is still being considered as fact finding; requiring
relevant security agencies to first study it before any legal action can be taken against persons indicted by the report.

Joined in the originating summons are the Federal House of Representatives, Farouk Lawan, the Attorney General of the Federation, the Economic and
Financial Crimes Commission, the Independent Corrupt Practices and Other Related Offenses Commission, and the Inspector General of Police.

The case was adjourned to October 18, for hearing.

    It is not surprising cos for somebdy like me,I have been expecting this for long due to the fact dat subsequent probe reports have gone the same way.

  2. Come what may,Nigerians are wactching the events critically .Judiciary which the last hope of ordinary citizens should not allow itself to be played with.posterity is there to judge all of us.

  3. That has always been the script. We are not surprised at how it is playing out. Unfortunately, the judiciary, which is often used to truncate truth and justice in this grand absurdity called Nigeria, has once again lived up to its ignominous billing. But when the chips are down, no one, not even the judiciary, will escape the wrath, vengeance and judgement of the masses.

If Nigerians seriously desire sincere justice they should request that all those involved in this scam be extradited to the united kingdom so that they can be properly investigated and thereafter prosecuted. Just like Ibori was extradited, prosecuted and jailed in the uk without any external or over bearing influence so also would these fuel subsidy scam artists be attended to once and for all. There are so many reasons for us to collectively protest and seek genuine and permanent redress. Especially in most of these egregious affairs that has beset us for so long. Rather we have chosen to remain aloof and watch Nigeria drift into a lawless and failed society.

     I can better you this whole Otedola and Farouk saga was specifically orchestrated to generate the current confused state it is beset with and thereafter die a permanent and natural death. At this stage Nigerians should not resign to faith and proclaiming that we anticipated this action and therefore nothing would come out of the probe. Rather we should continously strive to uphold justice in our judicial system by initiating mass protest that would insist on dispensation of a proper and incorruptible judicial process. If we allow this nonsense to continue unabated then we have failed in executing our basic civic responsibility and also we have renege in discharging our constitutional rights as patriotic citizens of naija. Ultimate power belongs to the masses and it is our collectives votes that has empowered these bigots who claim to be our leaders. And also our effective and well coordinated protest or legitimate votes should terminate their incompetent and corrupt system of governance once they have failed us. 

    The prosecution of gov. peter odili was upheld my our law courts. Till date nothing has been done to prosecute gov. peter odili or his cohorts who have benefited from the same corrupt and inept judicial process. The Egregious judicial process in Nigeria seems to be the only judicial system on plant earth where rich people commit humongous crimes and then utilise the same ill gotten wealth to avert the course of justice in their favour.  While the common man would be sent to life imprisonment if he is cut stealing a goat or chicken. Those who have stolen billions and impoverished the average Nigerians are allowed to use the same ill gotten wealth to thwart the course of justice while we sit and criticise. 

     We can continue to enjoy the comfort of our homes, sit back in our arm chairs and criticise our so called leaders or we can decide today that we have had enough. If we have decided that we have had enough of this unwholesome  nonsense then we have to let them realise that we have the power and if we cannot get the right services from them then we should occupy until things are done properly. Our judicial process is a mockery of what is expected of any typical modern day justice system.
